Privacy Policy
This Privacy Policy explains how 2784951 Alberta Inc. ("we," "us," "our," or "2784951 Alberta Inc.") collects, uses, discloses, stores, and protects personal information through mobile applications and related services (collectively, the "App" or "Services"). By downloading, accessing, or using the App, you consent to the practices described in this Policy. If you do not agree, please do not use the App.
Overview
We may update this Privacy Policy periodically. We will update the "Last Updated" date and notify you of material changes via the App or other reasonable means. Your continued use of the App after any changes constitutes your acceptance of the revised Policy.
Personal Information We Collect
"Personal information" or "personal data" includes any information that identifies, relates to, or could reasonably be linked with an identifiable individual, including sensitive or biometric data under applicable laws.
When you use the App, here is some of the information we may collect, depending on usage and the application:
- Identifiers and Contact Information: Name, email address, phone number, username, password or other account credentials, and unique device identifiers (e.g., advertising ID, IP address).
- Demographic and Profile Information: Gender, age/birthdate, height, weight, fitness goals, and other details you provide in your profile.
- Body Scan and Health-Related / Biometric Data: Body composition metrics (e.g., body fat percentage, muscle mass), measurements, body shape contours, and other scan-derived or biometric information. This data is generated from photos, videos, manual inputs, or compatible hardware you use (such as an 8-electrode body composition scale). We apply mathematical and computational models to process user-provided inputs into Body Scan Data. By using scan or photo features, you explicitly grant us permission to access, view, process, analyze, store, and use these inputs and derived data to provide and improve the Services.
- Usage and Technical Data: App interactions, device type, operating system, browser information, IP address, approximate geolocation (from IP or device settings), usage patterns, crash logs, and network activity.
- Video or photos submitted through the application.
- Inferences and Derived Data: Insights, progress trends, wellness estimates, or other inferences drawn from your data.
- Other Information: Any additional details you voluntarily submit via surveys, support requests, feedback, or in-app features (which may include health-related information).
We collect this data directly from you, your device, your interactions with the App, and compatible hardware. Some features require specific hardware; you are responsible for data from that hardware. Raw data may be uploaded to servers for processing. Data is encrypted in transit.
How We Use Your Personal Information
By using the App, you consent to our collection, viewing, processing, and use of your personal information (including biometric and health-related data) for the following purposes:
- To provide, operate, maintain, personalize, and improve the App, including processing scans, analysis, progress tracking, and delivering insights.
- To create and manage your account, authenticate you, and provide customer support.
- To generate personalized recommendations, progress reports, and wellness features.
- To communicate with you about the App, updates, promotions, security notices, or support, and to send you marketing and promotional messages (where consent is required by law, we will obtain it or rely on applicable legal bases).
- To conduct research, develop new features, analyze trends, and create anonymized or aggregated datasets that do not reasonably identify you.
- To market and present advertisements (including personalized or targeted ads) to you based on your use of the App and your preferences, subject to your opt-out choices where available.
- To comply with legal obligations, enforce our Terms of Use, protect our rights and property, prevent fraud or misuse, and ensure App security.
- To respond to legal requests, subpoenas, court orders, or governmental inquiries.
Disclosure of Your Personal Information
We share personal information only in these limited cases:
- With service providers and vendors (e.g., cloud hosting, analytics, payment processing, customer support, or advertising partners) who are contractually required to use the data only for the purposes we specify and to maintain appropriate security.
- With your explicit consent or at your direction (e.g., when you choose to share data with third-party services; we will describe the recipient and any compensation involved).
- With affiliates or business partners for internal operations, under appropriate protections.
- In connection with a merger, acquisition, reorganization, or asset sale (we will notify you if your data will be subject to a materially different privacy policy, where feasible).
- To investigate fraud, illegal activity, Terms violations, or to protect the safety, rights, or property of 2784951 Alberta Inc., our users, or the public.
- As required or permitted by applicable law, including in response to legal processes.
We do not sell your personal information as defined under laws like the CCPA/CPRA.
Security
We implement reasonable technical, administrative, and physical safeguards — such as encryption, access controls, and employee training — to protect your personal information, including images, videos, and Scan Data.
However, no system is perfect, and we cannot guarantee absolute security. Data transmission over the internet and storage are inherently risky. Despite our best efforts and industry-standard practices, unauthorized access, hacking, disclosure, loss, alteration, or breach of your data may still occur. To the maximum extent permitted by applicable law, we are not liable for any unauthorized access, use, disclosure, loss, or breach of your personal information (including photos, videos, or biometric data), even if resulting from a hack or security incident. You acknowledge these risks and agree that your use of the App is at your own risk. You are responsible for maintaining the confidentiality of your account credentials and for any data stored on your own device.
Your Rights and Choices
Depending on your location and applicable law (e.g., CCPA/CPRA, GDPR), you may have rights to access, correct, delete, restrict, or port your personal information, withdraw consent (where applicable), or opt out of certain processing like targeted advertising or marketing communications.
You can delete your account and associated data directly from within the App settings, in accordance with applicable law. You can also manage some preferences (e.g., notifications, marketing communications, or advertising options) directly in the App settings. To exercise other rights, contact us as described below. We will respond within legally required timeframes after verifying your identity. Some rights may be limited or denied by law.
Children's Privacy
The App is not intended for anyone under 18 (or the age of majority in your jurisdiction). We do not knowingly collect personal information from children under 18. Users under 18 are prohibited from using the Services. If we learn a child under 18 has provided data, we will delete it and take appropriate action. Contact us immediately if you believe a minor has used the App.
International Data Transfers
Your data may be transferred to, stored, and processed in the United States or other countries where we or our service providers operate. These countries may have different (or less protective) data protection laws than your home jurisdiction.
For EU/EEA/UK users: Your data is transferred to U.S. servers. The U.S. may not offer the same level of protection as EU/UK law, and government access for national security or law enforcement is possible (though we view the risk as remote). By using the App, you consent to these transfers. We use appropriate safeguards (e.g., standard contractual clauses) where required.
Notice to California Residents
See our separate Notice to California Residents (incorporated by reference) for CCPA/CPRA details. In the past 12 months, we have not sold or shared personal information as defined under these laws. We may have collected the categories listed above, including sensitive/biometric data. You have rights to know, delete, correct, and opt out. We do not discriminate for exercising your rights.
Notice to Individuals Outside the U.S.
Users in the EU/EEA/UK or other regions may have additional rights under local laws (e.g., GDPR). We process data based on consent, contract performance, legitimate interests, or other lawful bases. See our separate Notice to Individuals Outside of the U.S. (incorporated by reference) for details. You may complain to your local data protection authority.
Changes to This Privacy Policy
We may update this Policy at any time. The new version will be posted in the App with an updated "Last Updated" date. Continued use after changes means you accept the revised Policy.
